Subject: 10524/Code/24-322etseq/TempCommPkgPermits Date: Tue, 21 May 1996 13:59:12 -0500 ORDINANCE NO. 10524 AN ORDINANCE TO AMEND CHATTANOOGA CITY CODE, PART II, CHAPTER 24, BY AMENDING SECTION 24-322 AND BY INSERTING NEW SECTIONS 24-330, 24-331 AND 24-332. _________________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, that Chattanooga City Code, Part II, Chapter 24, be and is hereby amended by deleting Section 24-322(b) in its entirety and redesignating subsection (a) as Section 24-322. SECTION 2. BE IT FURTHER ORDAINED, that Chattanooga City Code, Part II, Chapter 24, be and is hereby amended by adding new Sections 24-330, 24-331 and 24-332 as follows: Sec. 24-330. Temporary reserved commercial parking permits, terms, etc. (a) In order to allow contractors or businesses with temporary parking needs to reserve on-street parking in the downtown area, the City Traffic Engineer, or his designee, may issue temporary commercial parking permits. (b) The application for a temporary commercial parking permit shall contain the name and telephone number of the owner of the motor vehicle(s), the name of the usual operator of such motor vehicle(s), the motor vehicle's make, model and license number, the street address and parking meter number(s) for the space(s) requested and the date(s) the space(s) are needed. (c) The City Traffic Engineer, or his designated representative, may issue permits to qualifying applicants for a fee of seven and 50/100 dollars ($7.50) per space per day. The City Traffic Engineer may in his discretion limit the number of spaces and the duration of the permit. The City Traffic Engineer shall not issue any temporary commercial parking permit if, in the Traffic Engineer's opinion, the use of such requested parking space(s) would interfere with any work in the right-of-way or with any event to be held in the 0C right-of-way. The Traffic Engineer may also limit the hours during which a temporary commercial parking permit may be used. (d) Upon approval of such permit, the City Traffic Engineer shall place a bag over the meter(s) reserved by the permit. The operator shall place in the windshield of the vehicle(s) the placard(s) issued for the permit. The placard(s) shall state clearly the vehicle make and model, the license plate number, the meter number(s) and date(s) for the reserved parking. Sec. 24-331. Privileges and restrictions on temporary commercial parking permits. The holder of a valid temporary commercial parking permit shall be permitted to stand or park a motor vehicle displaying the permit in the designated space(s) during such times as authorized by the permit. No vehicle other than the vehicle identified by the permit shall use such permit or display it on a vehicle operated or parked, and any such use or display by a person other than the permittee shall constitute a violation of this article by the permittee and by the person who so used or displayed such parking permit. Sec. 24-332. Revocation and suspension of temporary commercial parking permit. The City Traffic Engineer may revoke the temporary commercial parking permit of any permittee found to be in violation of this Chapter or in violation of any of the conditions placed upon the use of such permit. Upon written notification of such revocation, the permittee shall surrender such permit to the City Court or to the City Traffic Engineer. Failure to surrender a revoked temporary commercial parking permit when so requested shall constitute a violation of this Code. At any time the City Traffic Engineer determines that the continued use of any such temporary commercial parking permit may constitute a danger to the public health or safety, the Traffic Engineer shall suspend further use of such permit until such time as the Traffic Engineer shall determine that the further use of such permit shall no longer constitute a danger to the public health or safety. The use of any such temporary commercial parking permit which has been revoked or suspended shall constitute a violation of this Code. SECTION 3. BE IT FURTHER ORDAINED, that this ordinance shall take effect two (2) weeks from and after its passage as required by law.
